Terms of Service

These Terms of Service ("Terms") govern your access to and use of fortuna-studios.com and any related pages, emails, and services (together, the "Site"), operated by Paower Ventures LLC, a Florida limited liability company doing business as Fortuna Studios ("Fortuna Studios," "we," "us," or "our"). By visiting the Site, voting on an episode, joining our email list, or buying anything from us, you agree to these Terms, our Privacy Policy, and our Refund and Cancellation Policy. If you do not agree, do not use the Site.
1. Who can use the Site
You must be at least 13 years old to use the Site. You must be at least 18 years old, or the age of majority where you live, to make a purchase, or have the permission of a parent or legal guardian who agrees to these Terms on your behalf. By making a purchase you confirm that you meet these requirements.
2. The shows
Fortuna Studios publishes serialized story shows, starting with The Ticket, on Instagram, TikTok, YouTube, Facebook, and Snapchat. The shows are works of fiction. Any resemblance to real people, places, or events is coincidental. Where an episode describes a real law, rule, or process, we try to describe it accurately and cite our source, but nothing on the Site or in the shows is legal, tax, financial, or gambling advice. The shows do not offer, promote, or facilitate any lottery, game of chance, or gambling, and nothing you buy from us gives you a chance to win money or prizes.
3. Voting
Viewers choose what happens next by commenting on an episode. We count the latest comment from each account on each platform. Comments on Snapchat are not counted. Voting on each episode closes at 12:00 p.m. Eastern Time on the day after that episode is posted. We decide the result, and we may exclude votes we reasonably believe come from spam, automated, duplicate, or fake accounts. Vote totals shown on the Site are estimates and may be delayed. Voting is free and does not require a purchase.
4. Purchases
We sell digital products on the Site, including the Founder's Pass, High Rollers boosts, and memberships. All prices are shown in U.S. dollars at checkout. Payments are processed by Stripe. For purchases made through Stripe's Managed Payments service, Stripe or its affiliate acts as the seller of record and merchant of record, collects and remits applicable sales taxes, and its own terms, shown at checkout, also apply to your purchase. We never see or store your full card number.
All sales are final. Except where the law requires otherwise, we do not offer refunds, credits, or exchanges for any purchase. See our Refund and Cancellation Policy for full details.
5. Founder's Pass
The Founder's Pass is a one-time purchase. Its price rises as more passes are sold, and the price shown at checkout is the price you pay. Each pass includes a founder number, a listing on High Rollers, and, if you provide an Instagram handle, the display of that handle in the end credits of an episode as described below. The Founder's Pass is available until Day 30 of season one of The Ticket is posted, after which it is no longer sold. One pass is allowed per person and email address.
Names and the High Rollers ranking for each episode lock at 3:00 p.m. Eastern Time on the day the episode is posted. A handle received before that time appears in the end credits of that day's episode. A handle received after that time appears in the end credits of the next episode. Founders may be offered a membership at a founder rate. A founder rate applies only while that membership stays active and ends if the membership is cancelled or lapses.
6. High Rollers and boosts
High Rollers is a public list of founders ranked by the total amount each founder has paid for the Founder's Pass and boosts. Ties go to the founder who reached that total first. We do not show amounts. Boosts are optional one-time purchases available only to founders. Boosts only change your position on High Rollers and do not provide any other benefit unless we say so. Certain top-ranked founders may be represented in a show as illustrated characters drawn in our own style. We decide how any character looks, sounds, and is portrayed, and we may change or stop using a character at any time.
7. Memberships and automatic renewal
Memberships are subscriptions billed monthly or yearly. By buying a membership you authorize us and our payment processor to charge your payment method at the start of each billing period until you cancel. Your membership renews automatically at the then-current price for your plan unless you cancel before the renewal date. You can cancel at any time from your vault or by emailing us. When you cancel, you will not be charged again, and you keep access until the end of the billing period you have already paid for. We may change membership benefits or prices, and we will tell you before any price change applies to your next renewal.
8. Your name and your content
When you give us an Instagram handle or other name, you confirm that it belongs to you and that we may display it publicly on the Site, in the shows, in end credits, and in promotional material, without payment to you. We may refuse, shorten, or remove any name that we decide is offensive, hateful, sexual, infringing, misleading, impersonates another person, or is otherwise inappropriate. If we remove a name for these reasons, your purchase is not refunded. Comments you post on social platforms are governed by those platforms' terms, and you allow us to count, quote, and display them in connection with the shows.
9. Business cameos and sponsorships
Businesses may apply to appear in an episode. Submitting an application does not guarantee approval. We only ask for payment after we approve an application and the business approves the scene. We write and control all creative content. Sponsored content is marked as an advertisement. We do not accept casinos, sportsbooks, cryptocurrency, adult, or weapons businesses. Separate written terms may apply to a sponsorship, and those terms control if they conflict with these Terms.
10. Acceptable use
You agree not to misuse the Site. This includes attempting to access accounts or data that are not yours, interfering with the Site or its security, using bots or scripts to vote, buy, or scrape content, reselling or transferring anything you buy from us, recording or redistributing members-only videos, or using the Site for anything unlawful. We may suspend or end your access, remove your name, or cancel your membership if you break these Terms, without refund.
11. Our content
The shows, characters, artwork, music, text, logos, and all other content on the Site belong to Fortuna Studios or our licensors and are protected by copyright, trademark, and other laws. We give you a personal, non-transferable, revocable right to view the content for your own non-commercial use. You may share links to our posts. You may not copy, download, re-upload, or create works based on our content without our written permission.
12. Disclaimers
The Site and everything sold on it are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Site will always be available, that episodes will post on a particular schedule, that a show will continue for any length of time, or that the Site will be free of errors. Episode schedules, story directions, and features may change.
13. Limitation of liability
To the fullest extent the law allows, Fortuna Studios and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Site or anything you buy from us. Our total liability for any claim relating to the Site or these Terms is limited to the amount you paid us in the 12 months before the claim arose.
14. Indemnity
You agree to defend, indemnify, and hold harmless Fortuna Studios and its owners, employees, and partners from any claims, damages, and costs, including reasonable attorneys' fees, arising from your misuse of the Site, your content, or your violation of these Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts. Before filing any claim, you agree to email us and give us 30 days to try to resolve it informally.
16. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Changes apply from the date they are posted. If you keep using the Site after a change, you accept the updated Terms.
